MoveArt is a market research and buyer outreach service. We are not a licensed appraiser, art dealer, auction house, or gallery. All valuations provided through our platform are AI-generated estimates based on publicly available market data and are intended solely for marketing and informational purposes.

Our valuations are not certified appraisals and must not be used for, or relied upon in connection with: insurance coverage or claims; tax reporting or deductions (including IRS Form 8283); legal proceedings of any kind, including divorce settlements, estate disputes, or probate; estate planning or valuations; charitable donation substantiation; or any other purpose requiring a certified, legally defensible appraisal.

For purposes requiring a certified appraisal, you should engage a qualified professional accredited by the Appraisers Association of America (AAA), the American Society of Appraisers (ASA), or the International Society of Appraisers (ISA). MoveArt assumes no liability for any losses, damages, or adverse outcomes arising from the use of our AI-generated estimates for purposes other than market research and buyer identification.

The specified number of targeted, individually written buyer outreach emails (50, 100+, or 150+ depending on tier)
Campaign tracking and response summary

What We Don't Guarantee

We do not guarantee that your art will sell. Art sales depend on market conditions, pricing, buyer availability, and many other factors.
Valuations are AI-generated estimates based on market data — they are not certified appraisals.
Response rates vary by artwork, market, and timing.

Refund Policy

If our AI research determines your artwork has limited market viability before outreach begins, we offer a full refund or strategy consultation.
Once outreach emails have been sent, the service is considered delivered and is non-refundable.
If we fail to deliver the specified number of emails, you'll receive a pro-rated refund.

Your Representations

By using MoveArt, you represent that:

You are the legal owner of the artwork or authorized to sell it
All information provided about the artwork is accurate to the best of your knowledge
You authorize us to send emails on your behalf to potential buyers
You understand this is a marketing service, not a gallery, auction house, or art dealer

Limitation of Liability

MoveArt's liability is limited to the amount you paid for your campaign. We are not responsible for the outcome of negotiations between you and potential buyers.

Prohibited Submissions

You may not submit artwork that: (a) you do not legally own or have authority to sell; (b) is stolen, looted, or subject to repatriation claims; (c) contains materials restricted under CITES (ivory, tortoiseshell, certain woods) without proper documentation; (d) is subject to cultural heritage export restrictions under UNESCO conventions or national laws; (e) is a known forgery or reproduction presented as original. MoveArt reserves the right to decline any submission and report suspected violations to appropriate authorities.

Intellectual Property & Image Rights

You retain full ownership of all artwork images you upload to MoveArt.
By submitting images, you grant MoveArt a limited, non-exclusive, revocable license to reproduce, display, and share your artwork images solely for campaign purposes and buyer outreach. This license terminates upon campaign completion and image deletion.
You represent and warrant that you have the right to authorize reproduction and sharing of all artwork images you submit.
MoveArt retains ownership of all AI-generated research reports, valuation analyses, and campaign materials produced as part of your campaign.
You agree to indemnify and hold MoveArt harmless from any claims, damages, or expenses arising from copyright or intellectual property disputes related to images you submit.
Uploaded artwork images are permanently deleted within 12 months of campaign completion.

Anti-Money Laundering

MoveArt reserves the right to perform identity verification, refuse service, and report suspicious activity to appropriate authorities. We may decline campaigns for artworks where provenance, pricing, or transaction patterns raise compliance concerns.

Email Compliance (CAN-SPAM)

All buyer outreach emails sent on your behalf include our physical mailing address and an opt-out mechanism. We honor all opt-out requests within 10 business days in compliance with the CAN-SPAM Act.

Tax Implications

Art sales may trigger capital gains tax, sales tax, or reporting obligations depending on your jurisdiction, the sale price, and your tax status. MoveArt does not provide tax advice. Consult a qualified tax professional regarding any tax obligations arising from the sale of your artwork.

Governing Law

These terms are governed by the laws of the State of Florida. Any disputes will be resolved in Miami-Dade County, Florida.
